Terms of Service

1. Definitions

To make these Terms clearer, here are some basic definitions:

• Service: The KamerSchool platform and all related features, tools, websites, and APIs.
• School: The educational institution or organization that subscribes to our Service.
• User: Any individual authorized by a School to use the Service, including administrators, teachers, parents, and students.
• Content: Any data, text, files, information, images, or other materials submitted to the Service by a School or its Users, including student data, grades, and communications.

2. Eligibility and Account Registration

To use the Service, you must be authorized by a subscribing School. The School is responsible for creating and managing User accounts. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. User Conduct and Responsibilities

Acceptable Use

You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to, the following:

• Probing, scanning, or testing the vulnerability of any system or network.
• Breaching or otherwise circumventing any security or authentication measures.
• Uploading or sharing Content that is unlawful, harmful, defamatory, obscene, or infringing on intellectual property rights.
• Using the Service for any purpose other than for educational and school administration purposes as intended.

School Responsibilities

The School is solely responsible for:

• Its and its Users' compliance with these Terms.
• The accuracy, quality, and legality of all Content entered into the Service.
• Obtaining all necessary consents and permissions from parents, guardians, and staff to collect, store, and process their data within the KamerSchool platform, in compliance with applicable laws.

4. Privacy and Data Protection

We are a 'data processor' for the School's Content, and the School is the 'data controller'. We will only process data on behalf of and in accordance with the School's instructions.

5. Intellectual Property and Content Ownership

Your Content Belongs to You

The School retains all ownership rights to the Content it or its Users submit to the Service. We do not claim any ownership over your Content.

Our Limited License to Your Content

By using the Service, you grant KamerSchool a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, store, reproduce, modify, and display the Content, solely for the purpose of providing, maintaining, and improving the Service for you.

6. Fees and Payment

The Service is provided on a subscription basis. The School agrees to pay all applicable fees as described on our pricing page or in a separate agreement. All fees are non-refundable, except as required by law.

We reserve the right to change our fees with 30 days' prior notice. Your continued use of the Service after the fee change constitutes your agreement to pay the modified amount.

7. Termination

The School may terminate its subscription at any time. We may suspend or terminate your access to the Service if you materially breach these Terms. Upon termination, your right to use the Service will immediately cease, and we will, upon request, provide the School with an opportunity to export its Content.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAMERSCHOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a prominent notice within the Service.

Your continued use of the Service after such changes become effective constitutes your acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the competent courts located in Cameroon to resolve any legal matter arising from the Terms.
